General Conditions of Sale (GCS)

Article 1: Preamble and Legal Information

 

These General Terms and Conditions of Sale (GTC) apply without restriction or reservation to all sales concluded by Poupou Shop, a sole proprietorship (EI), whose registered office is located at 56 Avenue des Dragons de l'Impératrice, 33127 Martignas-sur-Jalle, France. Poupou Shop operates under the micro-enterprise regime and benefits from a basic VAT exemption (Article 293 B of the General Tax Code). Consequently, VAT is not applicable on invoices issued. In accordance with Article 293 B of the CGI, our prices are displayed without tax. These GTC govern the contractual relationship between Poupou Shop and any consumer, an adult individual not acting for professional purposes (hereinafter the "Client"), making a purchase on the website https://poupou.shop (hereinafter the "Site"). These GTC are written in French. Any order placed on the Site implies the Client's prior and unreserved acceptance of these GTC. Poupou Shop reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the Client's order.

 

Article 2: Products

 

Poupou Shop offers for sale collectible items, figurines, and decorative objects inspired by our Poupou collection. The main characteristics of the products are presented on the Site for each product page. The photographs and descriptions of the products are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors or slight variations in appearance due to manufacturing. Product availability is clearly indicated on the Site. In the event of a product's unavailability after the order has been placed, the Client will be informed by email as soon as possible. The order will be automatically canceled, and the Client will be reimbursed for the amount of the unavailable product, as well as the associated delivery fees, as soon as possible.

 

Article 3: Price

 

The prices of the products are indicated in Euros (€) and are displayed excluding delivery fees. In accordance with Article 293 B of the General Tax Code, VAT is not applicable to our prices. Delivery fees are free for all orders. Poupou Shop reserves the right to modify its prices at any time, but the price invoiced to the Client will be the one in force at the time the order is confirmed.

 

Article 4: Order

 

Placing an order on the Site follows these steps:

  1. Selection of the product(s) and addition to the cart.

  2. Cart validation.

  3. Client identification (existing account) or account creation.

  4. Entry of delivery and billing information.

  5. Choice of payment method.

  6. Verification of the order summary and express acceptance of these GTC (via a checkbox).

  7. Payment validation. The order will only be considered final after Poupou Shop has received the full price and sent the Client an order confirmation by email.

 

Article 5: Payment

 

Payment is made online only by credit card (Visa, MasterCard, American Express). Transactions are fully secured through the SSL encryption system. Poupou Shop does not have access to the Client's payment details; this information is processed directly by our secure payment provider. The credit card is debited at the time the order is confirmed.

 

Article 6: Delivery

 

Products are delivered to the address indicated by the Client during the order. The estimated delivery time is 5 to 7 business days from the date the order is shipped. This timeframe includes the preparation of your package and its transit. A tracking number will be sent to the Client by email as soon as the order is shipped, allowing for real-time package tracking. Poupou Shop cannot be held responsible for delivery delays due to force majeure or unpredictable and insurmountable events (such as carrier strikes, exceptional bad weather, natural disasters, etc.). In the event of non-receipt of the order within the indicated timeframe, the Client is invited to contact Poupou Shop's customer service at poupou.shopy@gmail.com or by phone at +(33) 6 51 86 37 06. If the investigation conducted by the carrier confirms the loss of the package, Poupou Shop agrees to ship a new product to the Client (subject to availability) or to issue a full refund for the order if the product is no longer available.

 

Article 7: Right of Withdrawal and Returns

 

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Client has a right of withdrawal of fourteen (14) calendar days from the date of receipt of the product, without having to provide a reason or pay a penalty. Article 8: Legal Guarantees

 

All products sold by Poupou Shop benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code) and the legal guarantee against hidden defects (Articles 1641 et seq. of the Civil Code). Legal guarantee of conformity: Poupou Shop is required to deliver goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. The Client can take action within a period of two years from the date of delivery of the goods. In the event of a conformity defect, the Client can choose between repair or replacement of the goods, or if these options are impossible, a reduction in the price or the cancellation of the contract. Legal guarantee against hidden defects: Poupou Shop is liable for hidden defects in the sold item that make it unfit for its intended use, or that diminish this use so much that the buyer would not have acquired it, or would have paid a lesser price for it, had they known about them. The Client can take action within a period of two years from the discovery of the defect. Article 9: Liability

 

Poupou Shop cannot be held liable for any inconveniences or damages inherent in the use of the Internet network, including a service interruption, external intrusion, the presence of computer viruses, or any event qualified as force majeure.

 

Article 10: Personal Data

 

The personal information and data concerning the Client are necessary for the management of the order, the delivery of the products, and the commercial relationship. They may be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders (carriers, payment platforms) for their management, execution, processing, and payment. This information and data are also kept for security purposes, to comply with legal and regulatory obligations. In accordance with the "Informatique et Libertés" law of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) n°2016/679 of April 27, 2016, the Client has a right of access, rectification, deletion, opposition, limitation, and portability of data concerning them. Article 11: Intellectual Property

 

All elements of the Site (texts, product images, logos, trademarks, databases, etc.) are the exclusive property of Poupou Shop or its partners and are protected by copyright, trademark law, and all other intellectual property rights. Any reproduction, exploitation, redistribution, or use in any capacity, even partially, of the elements of the Site and particularly of the products presented, is strictly prohibited without the prior written consent of Poupou Shop.

 

Article 12: Applicable Law - Disputes - Mediation

 

These GTC are subject to French law. In the event of a dispute, the parties will endeavor to find an amicable solution. In accordance with Articles L.612-1 et seq. of the Consumer Code, in the event of a dispute that could not be resolved amicably, the Client has the possibility of resorting to a consumer mediator free of charge.
