General Terms and Conditions of Sale (GTC) – Poupou Shop

 

Article 1: Preamble and Legal Information

These General Terms and Conditions of Sale (GTC) apply without restriction or reservation to all sales concluded by Pejman, a sole proprietorship (EI) operating under the trade name Poupou Shop, with its registered office located at 56 Avenue des Dragons de l'Impératrice, 33127 Martignas-sur-Jalle, France. Consequently, VAT is not applicable to the invoices issued. In accordance with article 293 B of the CGI, our prices are displayed exclusive of tax. These GTC govern the contractual relationship between Poupou Shop and any consumer, a natural person of legal age not acting for professional purposes (hereinafter the "Customer"), making a purchase on the website https://poupou.shop (hereinafter the "Site"). These GTC are written in French. Any order placed on the Site implies the Customer's prior and unreserved acceptance of these GTC. Poupou Shop reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the Customer's order.

Article 2: Products

Poupou Shop offers for sale collectible items, figurines, and decorative objects inspired by our Poupou collection. The main characteristics of the products are presented on the Site for each product page. The photographs and descriptions of the products are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors or slight variations in appearance due to manufacturing. Product availability is clearly indicated on the Site. In the event of a product being unavailable after an order has been placed, the Customer will be informed by email as soon as possible. The order will be automatically canceled, and the Customer will be refunded the amount of the unavailable product, as well as the associated delivery costs, as soon as possible.

Article 3: Prices

The prices of the products are indicated in Euros (€), and are displayed exclusive of delivery costs. In accordance with article 293 B of the French General Tax Code, VAT is not applicable to our prices. Delivery costs are free for all orders. Poupou Shop reserves the right to modify its prices at any time, but the price invoiced to the Customer will be the one in force at the time the order is validated.

Article 4: Order

Placing an order on the Site follows these steps:

Selection of the product(s) and adding to the cart.

Cart validation.

Customer identification (existing account) or account creation.

Entry of delivery and billing information.

Choice of payment method.

Verification of the order summary and express acceptance of these GTC (by checking a box).

Payment validation. The order will only be considered final after Poupou Shop has received the full price and sent the Customer an order confirmation by email.

Article 5: Payment

Payment is made online only by credit card (Visa, MasterCard, American Express). Transactions are fully secured using SSL (Secure Socket Layer) encryption. Poupou Shop does not have access to the Customer's payment details, as this information is processed directly by our secure payment provider. The credit card is debited at the time the order is validated.

Article 6: Delivery

The products are delivered to the address indicated by the Customer when placing the order. The estimated delivery time is 5 to 7 business days from the date the order is shipped. This time includes the preparation of your package and its transportation. A tracking number will be communicated to the Customer by email upon shipment of the order, allowing them to track the package's progress. Poupou Shop cannot be held responsible for delivery delays due to force majeure or unforeseeable and insurmountable events (such as carrier strikes, exceptional weather, natural disasters, etc.). In the event of non-receipt of the order within the indicated timeframes, the Customer is invited to contact Poupou Shop customer service at poupou.shopy@gmail.com or by phone at +(33) 6 51 86 37 06. If the investigation conducted by the carrier confirms the loss of the package, Poupou Shop undertakes to ship a new product to the Customer (subject to availability) or to proceed with a full refund of the order if the product is no longer available.

Article 7: Right of Withdrawal and Returns

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has a right of withdrawal of fourteen (14) calendar days from the date of receipt of the product, without having to provide reasons or pay penalties. Article 8: Legal Guarantees

All products sold by Poupou Shop benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Legal guarantee of conformity: Poupou Shop is required to deliver goods that conform to the contract and is responsible for defects in conformity existing at the time of delivery. The Customer can take action within a period of two years from the delivery of the goods. In the event of a lack of conformity, the Customer can choose between repair or replacement of the goods, or if these options are impossible, a price reduction or termination of the contract. Guarantee against hidden defects: Poupou Shop is bound by the guarantee against hidden defects of the item sold which render it unfit for its intended use, or which so diminish that use that the buyer would not have acquired it, or would have given a lower price for it, had they known about them. The Customer can take action within a period of two years from the discovery of the defect. Article 9: Liability

Poupou Shop cannot be held responsible for inconveniences or damages inherent in the use of the Internet, particularly a service interruption, an external intrusion, the presence of computer viruses, or any event qualified as force majeure.

Article 10: Personal Data

Personal information and data concerning the Customer are necessary for the management of the order, the delivery of products, and the commercial relationship. They may be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders (carriers, payment platforms) for their management, execution, processing, and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the "Informatique et Libertés" law of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) No. 2016/679 of April 27, 2016, the Customer has the right to access, rectify, delete, object to, limit, and port their data. Article 11: Intellectual Property

All elements of the Site (texts, product images, logos, trademarks, databases, etc.) are the exclusive property of Poupou Shop or its partners and are protected by copyright, trademark law, and all other intellectual property rights. Any reproduction, exploitation, redistribution, or use for any purpose, even partially, of the elements of the Site and in particular the products presented, is strictly prohibited without the prior written consent of Poupou Shop.

Article 12: Applicable Law - Disputes - Mediation

These GTC are subject to French law. In the event of a dispute, the parties will endeavor to find an amicable solution. In accordance with articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably, the Customer has the possibility of free recourse to a consumer mediator.
